City council explores options on sod

Dissatisfied with Bauerly Brothers and the lack of sod on the 1995 Street Project, the Paynesville City Council discussed ways to correct the situation at their Wednesday night meeting.

The council approved a $26,160 payment to Bauerly Brothers but retained $20,096 until the sodding was completed. The council had discussed not paying the $26,160 but City Attorney Bill Spooner said technically that needed to be paid.

The council discussed the possibility and approved seeking liquidated damages from May 15 up until the time the sod is laid.

Rich Pederson, SEH engineer, said the 1995 Street Project was considered completed on Nov. 1, with the exception of sidewalks and sodding, which were completed in May.

On Nov. 17, 1995, a review of the project provided a punch list. Ten days were given to complete the items, sign and initial the list, and return it to SEH. SEH has not received the punch list back and many items are still not corrected to date.

A letter had been sent to Bauerly Brothers on June 12 expressing the need to have sod down before June 17. The council awaits a reply.
